How the Agreement on pension provision for workers of the member states of the Eurasian Economic Union is being implemented.

History

On December 20, 2019, a meeting of the Supreme Eurasian Economic Council was held, at which the heads of the member states of the Eurasian Economic Union (EAEU) signed the Agreement on pension provision for workers of the member states of the Eurasian Economic Union, according to which each EAEU member state guarantees citizens of other member states of EAEU a volume of rights to pension provision equal to the volume of rights provided to its citizens under similar conditions.

From January 01, 2021, after ratification of the Agreement by all EAEU states, their citizens working in other EAEU countries form, maintain and exercise their pension rights on an equal basis with citizens of the country in which they are employed. Each EAEU member state now pays a pension according to its legislation for the work experience acquired by a worker on its territory after January 01, 2021. If the work experience of a worker acquired in the territory of one member state is not enough to qualify for a pension (with the exception of a funded pension), then work experience acquired in other EAEU countries is taken into account, including before the Agreement entered into force, except in cases where such work experience coincides in time. It is worth noting that citizens of the EAEU countries must formalize labor relations with employers in the countries of employment, that is, they must enter into labor or civil law contracts in a timely manner.

Implementation of the Agreement in Kazakhstan

In Kazakhstan, the Agreement applies to legal relations for the payment of pension contributions to the UAPF and to pension benefits from the UAPF under the legislation of the Republic of Kazakhstan upon reaching retirement age or when disability of groups 1 and 2 is established for an indefinite period.

For example, if a citizen of Kazakhstan acquires work experience (for example, 3-5 years) in the territory of a member country of the EAEU after the entry into force of the Agreement, then if the right to a pension arises under the terms of the pension legislation of the country of employment (reaching retirement age, having a certain work experience), the country in which the migrant worked will assign a pension for the length of service worked in that country. In this case, a citizen of Kazakhstan will have the right to submit an application with documents for the appointment and payment of a pension to the competent authority of the EAEU country or to the UAPF, as the competent authority in the Republic of Kazakhstan.

The list of documents for assigning and paying a pension to a worker is regulated by the national legislation of each EAEU member state.

Athourities

The competent authorities in the Republic of Kazakhstan to confirm the length of service of workers of the EAEU member states are UAPF JSC, the Committee of Labor and Social Protection of the Population of the Ministry of Labor and Social Protection of the Population of the Republic of Kazakhstan and their territorial divisions.

The UAPF provides information on work experience since January 1, 1998, based on data on the payment of mandatory pension contributions available in the information system.

To confirm your work experience before 1998, you must contact the Committee of Labor and Social Protection of the Population of the Ministry of Labor and Social Protection of the Population of the Republic of Kazakhstan.

Agreement in numbers

As part of the implementation of the Agreement in the Republic of Kazakhstan, from January 01, 2021 until February 01, 2024:

• 82,845 working citizens of the EAEU member states carrying out labor activities on the territory of Kazakhstan on the basis of labor and civil law contracts concluded with employers were transferred pension contributions to the UAPF and opened individual pension savings accounts without application;

• The UAPF accepted and executed applications for pension benefits from 94 citizens of the EAEU member states, of which:

- 91 workers were assigned pension benefits in connection with reaching retirement age according to the legislation of Kazakhstan;

- 3 heirs were assigned pension payments in connection with the death of two workers;

• 4 citizens of Kazakhstan who carried out labor activities in the territory of the Kyrgyz Republic and the Russian Federation on the basis of an employment contract and transferred insurance contributions to their pension system were assigned lifelong old-age pensions by the competent authorities of these countries.
