1. After the death of my father, I, as the sole heir, claim his pension savings. Do I need to make a request to UAPF about the amount available on his account or do I need to contact a notary?
UAPF JSC in accordance with the Law of the Republic of Kazakhstan On Pension Provision in the Republic of Kazakhstan, in the event of the death of a contributor (beneficiary), issues certificates on the existence of an individual pension saving account, on the balances and movements of funds on it upon written request to the heirs in accordance with the certificate of the right to inheritance by law or specified in the will, or by the courts on the basis of a ruling on inheritance cases in their proceedings, as well as notaries and foreign consular offices in inheritance cases in their proceedings.
To optimize interaction and save time, as well as to eliminate unnecessary paperwork, with the help of the E-notariat Unified Notary Information System, notaries themselves can send requests to the UAPF about whether deceased contributors (beneficiaries) have an individual pension saving account in the UAPF, about balances and the movement of money on it online, without sending written requests.
Therefore, when registering with a notary the inheritance property in the form of your father's pension savings, you do not need to make a request to the UAPF about the amount available on his pension account.
2. I read that pension accounts of UAPF contributors will be closed if no deductions are made to them? I am currently unemployed as I was laid off. Does this mean my account will close? Where will my savings go in this case?
No, your account will not be closed, as we understand that your IPSA has pension savings that were transferred earlier when you were still working.
According to the Rules for keeping records of pension savings from compulsory pension contributions, compulsory occupational pension contributions and voluntary pension contributions on individual pension saving accounts of contributors (beneficiaries), approved by the Resolution of the Board of the Agency of the Republic of Kazakhstan for Regulation and Development of the Financial Market dated February 12, 2021 No. 27, IPSA of contributors (beneficiaries) are closed after one month, provided there are no pension savings.
As long as your IPSA has at least some amount of pension savings, but it is temporarily not replenished, your IPSA will not be closed. Moreover, it will continue to accrue investment income.
Recall that unclaimed amounts of pension savings are not subject to write-off by the UAPF until the demand for this amount by the beneficiaries or their heirs.
In the future, when you apply for a job, your pension contributions will continue to flow into your current IPSA.
3. From January 1, 2024, compulsory pension contributions from the employer to the UAPF at the expense of the employer's own funds will be introduced. How does this happen and is there such a practice in developed countries?
Within the framework of collective (corporate) pension plans, widely used in developed countries (Great Britain, USA, Canada, New Zealand), the employee and the employer make joint contributions to the employee's pension account, i.e. the employer shares the responsibility for the pension provision of its employees.
The employer's contribution to the employee is financed from its own funds. Employers use this opportunity as a tool to increase employee loyalty, attract and retain key personnel, and to ensure a higher level of retirement income for employees after retirement. In Kazakhstan, the participants of the new pension system will be employees, in favor of whom employers will transfer the employer's compulsory pension contributions calculated from the monthly income of employees and transferred at the expense of the employer's own funds to personalized notional pension saving accounts (hereinafter referred to as NPSA) in the UAPF.
The opening of the NPSA in the UAPF for accounting of the ECPC will be carried out on the basis of the list of individuals submitted by the agent to the UAPF through the State Corporation "Government for Citizens", when transferring the ECPC. For each participant in the system, it is envisaged to open the NPSA in automatic mode on the day the lists of individuals are accepted, upon receipt of the first installment or penalty in favor of an individual without a NPSA with the assignment of a unique NPSA number.
At the same time, it is planned to gradually introduce the ECPC in the following order: from January 1, 2024 - in the amount of 1.5 percent, with an annual increase of 1 percent - until reaching 5 percent from January 1, 2028.
The phased introduction of ECPC will alleviate the burden on the employer.
It should be noted that the ECPC will be paid out only for workers born after January 1, 1975.
Persons who have reached retirement age, as well as persons with disabilities of the first and second groups, if the disability is established indefinitely, with at least 5 years (60 months) of participation in the ECPC system, will be entitled to pension benefits at the expense of the ECPC.
The maximum size of the pension benefit at the expense of the ECPC cannot exceed two times the subsistence minimum established for the corresponding financial year by the law on the republican budget.
Pension benefits at the expense of ECPC are assigned for life, paid for the current month and are made for the month of death or departure for permanent residence outside the Republic of Kazakhstan, inclusive.
Please note that, unlike the accumulative pension system, pension savings at the expense of the ECPC in the conditional funded component are not inherited (since they are not the property of the employee and the employer), are not subject to withdrawal from the UAPF in the form of lump-sum pension benefits in order to improve housing conditions and (or) to pay for treatment from the UAPF, cannot be transferred to the trust management of the IPM, and they are not covered by the state guarantee of the safety of pension savings.
The government, along with the introduction of the ECPC, is considering the possibility of reducing the burden on the employer's payroll by reducing social payments and tax breaks. In general, with the introduction of the ECPC, responsibility for providing pensions to citizens will be distributed between the state, the employee and the employer.
4. I can’t log into the mobile application, I wanted to change my phone number?
If you change the specified number, then you have two ways to make changes and update your personal data:
1) on the site enpf.kz in the section "Electronic Services" select the subsection "Make changes and (or) additions to the details", enter the page using an electronic digital signature (EDS);
2) through the branches of UAPF and Kazpost JSC.
On the site you can not only make changes and additions to your details, but also get a certificate of availability of IPSA, get as statement from IPSA, send an appeal with a question of interest, order a Mobile Office visit, call back, calculate the predicted amount of a future pension using "Pension Calculator". Also, through it, you can track the status of your account, find out about all changes in the pension system, see the location of the nearest UAPF office, and even call the contact center.
Also, each UAPF contributor, using the website and mobile application, can find out if he has enough funds for IPSA to exercise his right to use part of his pension savings for housing improvement or treatment, or for transfer to companies managing the investment portfolio.
5. Can I pay SAP in the current month for the past and how to do it?
We want to remind you right away that the operation of the Single Aggregate Payment (SAP) as a tax regime for self-employed citizens was provided by the Tax Code only for a 5-year period - from 2019 to 2023, that is, it is valid only until the end of the current year.
SAP is payable in total. Payment of SAP is made by depositing SAP by the payer in cash or by bank transfer through banks and organizations carrying out certain types of banking operations to the bank account of the State Corporation "Government for Citizens" subject to the requirements of the Law of the Republic of Kazakhstan "On Payments and Payment Systems".
Payment of SAP by payers is carried out independently or by a third party in their favor, indicating the month of the calendar year for which SAP is paid in the format "MMYYYY".
At the same time, SAP can be paid for the current and subsequent months of the calendar year.
SAP Amount:
1 MCI - for individuals residing in the cities of republican significance, the capital and regional significance (KZT3,450.00 in 2023);
0.5 MCI - for individuals living in other settlements (KZT1,725.00 in 2023).
SAP combines four mandatory wage types:
• compulsory pension contributions to the UAPF (30% of the total amount of SAP);
• personal income tax (10% of the total SAP amount);
• social contributions to the State Social Insurance Fund (20% of the total amount of SAP);
• contributions to the Social Health Insurance Fund (40% of the total SAP).
